CAREFULLY READ THE FOLLOWING LICENSE AGREEMENT.
1. Definitions
This License Agreement is for the software product identified below, which includes
computer software and may include associated media, printed or electronic documentation
and online services, hereafter referred to as Software.
"You" means the person or company who is being licensed to use the Software.
"We," "us" and "our" means Sigmasoft Inc.
2. License types and Grant
This license agreement refers to:
a. Sigma Linb components libaray - Single Developer License
b. Sigma Visual AJAX UI builder - Single Developer License
c. Sigma Grid components - Single Developer License
3.Ownership, Title, License Grant
This is a license agreement and not an agreement for sale. We continue to own the
title, copyright, and other intellectual property rights in the Software
and its
Modifications.
We grant to you a limited, non-transferable and non- exclusive right
to use, royalty-free,
copy and modify the Software and/or Modifications by
one single developer at a time. It is allowed to use the software on unlimited number
of websites and projects (applications).
The License contains the right to apply for the following service free of charge
- Tech support on the product within one month since purchasing the product
- Elimination of any found bugs during within one month since purchasing the product
- Free upgrade for one month since purchasing the product
4.Prohibited Uses
Except as contemplated above with respect to Redistribution Licenses,
you may not:
- Use any part of the Software or Modifications or your knowledge of the Software
to create a product with the same or substantially the same functionality as the
Software
- Sublicense, rent, lease or lend any portion of the Software or Documentation
- Modify or remove any copyright notices from any of the Software files.
5. Termination
This License Agreement and Your right to use the Software and Modifications will
terminate immediately without notice if You fail to comply with the terms and conditions
of this License Agreement. Upon termination, You agree to immediately cease using
and destroy the Software or Modifications, including all accompanying documents.
The provisions of sections 3 to 7 will survive any termination of this License Agreement.
6. Disclaimer Of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIGMA
SOFT INC DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING,
BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE SOFTWARE. SIGMA SOFT INC
DOES NOT GUARANTEE THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
7. Limitation Of Liabilities
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
IN NO EVENT SHALL SIGMA SOFT INC BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT
OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR
LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION OR
ANY OTHER PECUNIARY LAW) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.
